Birth injuries can turn childbirth into a tragedy

The United States is often considered the greatest country in the world. It is unfortunate, however, that a nation as advanced as the United States has one of the highest rates of birth injuries out of any developed nation. Every year, thousands of families in Delaware and across the country are faced with tragedy during what should be a joyous occasion. Injuries suffered at birth can affect a child for the rest of his or her life.

In another state, a boy allegedly suffered injuries during birth that permanently damaged his right shoulder and his family filed a lawsuit. According to the lawsuit, the boy became lodged by his shoulders in his mother’s birth canal during delivery. Allegedly, he was stuck for nearly nine minutes.

Physicians were eventually able to free the infant, but the lawsuit claimed that the baby suffered injuries to the bundle of nerves that extend from the throat portion of his cord known as the brachial plexus. The mother alleged that the injuries to her baby should not have happened because the infant was around 11 pounds at the time of birth and she had requested a C-section delivery. The plaintiffs were awarded over $8.2 million in the lawsuit. 

Childbirth is a very delicate and fragile process that should always be handled with extreme care and precision. Any deviation from the accepted standard of care could result in birth injuries. Delaware families who have been affected by negligent care during childbirth may want to consider discussions with an experienced attorney.
