According to the lawsuit, the mother worked as a nursing assistant and was inadvertently kicked in the stomach while she was pregnant. After visiting the hospital to be checked, the lawsuit said a heart monitor showed some issues with the baby’s heartbeat. The mother said baby was delivered via cesarean section after a delay of about three hours.
Allegedly, the baby suffered a brain dysfunction that occurred due to a lack of oxygen. The lawsuit alleged that a treatment for this condition known as head cooling was considered but was not administered by providers. Also, the brain injury could have been prevented if the baby was given a blood transfusion more quickly, the lawsuit claimed. The girl suffered permanent injuries to her brain, according to the lawsuit. A jury sided with the family and awarded the plaintiffs total damages of $23.6 million.
