Car accidents mar the holidays for many Delaware families

The holidays can be challenging for many Delaware families, and it only gets worse when one member suffers severe injuries in a crash — especially if the injured victim is a child. The only thing that makes the devastation worse is if the driver believed responsible fails to remain at the scene. Not knowing even for a day or two who was behind car accidents can be frustrating and heartbreaking for families that need answers.

When one Delaware family heard that a 12-year-old family member suffered severe injuries in a hit-and-run crash, not only did they not know if the boy was going to survive his injuries, but they also did not know who was responsible for him being in the hospital. Preliminary reports of the accident, which took place on Route 13, indicated that the boy was crossing a street on a recent Monday evening at approximately 5:40 p.m. when a car struck him. Police did manage to find surveillance video of the vehicle involved.

It is not known whether that video prompted the 55-year-old woman who was driving the car to finally come forward. As she faces charges relating to her failure to remain at the scene, the boy was last listed as being in guarded, but stable condition. At the time, his mother did not think that he would be home for Christmas. He requires surgeries, and he could remain hospitalized into Jan. 2017.

As this boy struggles to survive and recover from his injuries, his family is undoubtedly incurring significant financial losses. Now that the driver who police say struck the boy is known, a personal injury claim could be filed against her. If the family successfully proves that her negligence put the boy in the hospital, an award of damages similar to others seen in car accidents could help them with the medical expenses and other financial losses incurred because of this tragedy.
