A pregnant woman who tragically died has finally been given justice by a state court, according to local sources. The 24-year-old woman passed away as a result of complications of brain injuries she apparently received while in the hospital. Delaware residents will be pleased to hear that her family, including her daughter who is now two years old, have been awarded $4.3 million in damages.
According to the filing, the woman came to the hospital on Aug. 8, 2014 complaining of shortness of breath. As she was 33 weeks pregnant at the time, she was admitted to the hospital. Some eight hours later, she apparently suffered oxygen loss that caused a brain injury that left her in a persistent vegetative state for the next three months. She passed away as result of this injury on Nov. 18, 2014.
Doctors were able to save her unborn daughter using an emergency c-section technique that forewent sterility and anesthesia in order to save the baby before the mother died. After a lengthy court case, the family was awarded $4.3 million for economic and non-economic damages. However, representation for the family is requesting a closer look at their state’s cap on non-economic damages, suggesting the award should have been much higher.
When brain injuries or other ailments are directly traceable to a failure in the medical community to properly diagnose or monitor a patient, families are often offered the ability to file for malpractice in a state court.
