A family who lost a father and husband back in 2013 has finally been given the justice it deserves. Delaware residents are sure to be pleased at the news that a lawsuit filed on behalf of a 37-year-old man who died due to brain injuries has finally been settled. The exact amount of the settlement has not been publicly announced, but sources say the total equals at least $3.75 million.
The settlement was reached in June 2016 after a hard-fought battle against a hospital and its staff who were deemed responsible for the man’s death. According to the filing, he had been scheduled for a routine endoscopy to determine the cause of problems he was having with swallowing. He was put under conscious sedation for the duration of the procedure, during which medications were introduced to control pain and anxiety. Usually this requires an anesthesiologist to be present, but in this case, the hospital relied on nurses.
The man was given more than double the recommended dose of sedatives and improperly monitored during the procedure. Nurses on the scene also reportedly ignored warning signs of the oxygen deprivation that would ultimately lead to the brain damage that killed him. The autopsy performed after his death revealed no cause of death outside of those injuries.
