Delaware’s Injury & Medical Malpractice Leaders

When surgical errors lead to malpractice suits

Undergoing surgery can be a stressful experience for anyone. As some Delaware residents are keenly aware, the threat of surgical errors and other medical errors can exacerbate that stress. However, victims of medical errors do have the option to file a malpractice suit against the doctors and medical organizations responsible for these errors. While this may not mean the errors are corrected, filing a suit at least allows for the possibility of compensation for the afflicted party.

A medical malpractice suit is defined by certain determining characteristics. While many suits are filed as a result of a misdiagnosis or error in care, more serious suits — like those filed for surgical errors — usually depend on other factors to make a case in court. Primary among these is if an injury can be directly correlated to a medical error.

In the case of surgical errors, such injuries can usually be linked to a failure on the part of a medical professional to either provide the proper care or to conduct the surgery in the proper manner. The implications of surgical errors can be long-lasting and far-reaching for the patient. This is why medical malpractice extends to cover such errors.

Surgical errors can cause life-long health problems, not to mention the potential for the condition to worsen or become fatal. Delaware residents who believe their doctor may have committed a surgical error should seek the advice of a qualified attorney before filing a malpractice suit. With the support of an experienced professional, the potential to be awarded compensation increases dramatically.
