Birth injuries can turn a joyful event into a tragedy

On Behalf of | Oct 3, 2018 | Birth Injuries

The moment of birth is the most fragile time in a person’s life. Childbirth is a process that must be handled with extreme care. Any deviation from the acceptable level of care can result in birth injuries that could affect a child for the rest of his or her life. Understandably, this is a nightmarish scenario for parents in Delaware and around the country.

A mother in another state was recently awarded almost $9 million from a lawsuit she filed over allegations that negligence during birth left her son with severe injuries. During prenatal care visits, the woman claimed that her midwife projected the boy’s weight to be around 6 pounds at birth. However, the lawsuit said boy turned out to be much larger and was 10 1/2 pounds at birth.

Due to his large size, the boy’s shoulders got stuck in the birth canal during delivery, according to the lawsuit. Allegedly, the midwife grabbed the baby’s head and forcefully pulled the infant out of the birth canal. The plaintiff claimed that the excessive force resulted in the boy suffering a broken arm and severe nerve damage. After his birth, the boy required two surgeries to repair nerve damage and restore the use of his right arm, the lawsuit claimed.

Childbirth is a magical time and a joyous event that Delaware families will always remember. Unfortunately, negligence can turn this wonderful event into a time of tragedy. Families of those who have suffered birth injuries could benefit from discussions with an experienced legal representative. A successfully litigated claim could result in a monetary award to help families recover from this tragic experience.
