Delaware car accidents: 2 bicyclists killed after crash

On Behalf of | Oct 30, 2017 | Car Accidents

Sadly, some people in Delaware find themselves in the wrong place at the wrong time through no fault of their own. Recently, two men lost their lives when they became victims of a deadly car crash. Dealing with the aftermath of car accidents such as this one can be confusing and complicated for loved ones of deceased victims.

The men, ages 58 and 53, had apparently been riding their bicycles when the tragedy occurred. One cyclist was standing on the shoulder of a road and the other on the sidewalk. Both were in front of a restaurant when an SUV crashed into them. With nothing to protect them, both victims were killed at the scene.

The initial investigation indicates that the 61-year-old driver of the SUV may have had a medical issue. It is believed that he became unconscious as he was driving. He lost control of his car, which crossed over into the opposite lane prior to crashing into the victims. His vehicle eventually came to a stop after crashing into another empty vehicle. He is being medically treated for his injuries.

When car accidents of this nature occur, the issue of negligence may be difficult to determine. If a driver asserts that he or she suffered an acute medical condition, it will be incumbent on the driver to prove that the medical condition was sudden and unexpected. If, for instance, a driver had a heart condition and had been advised not to drive, a wrongful death claim under similar facts would likely be successful. The surviving family of a deceased accident victim in Delaware may benefit by seeking the counsel of an experienced personal injury attorney to determine all possible sources for legal recourse.
