It is unfortunate when Delaware patients suffer as a result of a medical professional’s negligence. Inaction or a wrong decision can result in a lifetime of medical treatment, expenses, lost quality of life and/or death. Recently in a neighboring state, a couple was awarded an $8 million monetary settlement for the brain injuries their child suffered that may have resulted or compounded by one physician’s delayed action.
Near the end of her pregnancy the mother notified her physician at the health clinic where she received her prenatal care of concern about her baby’s decreased fetal movements, and she was admitted to a nearby hospital for further evaluation and treatment. Despite knowledge of decreased movements, the physician did not personally evaluate her for about three hours. Once her physician saw and analyzed the fetal movements, he determined the mother was in immediate need of a cesarean section to deliver her baby.
The baby was delivered but suffered numerous injuries. The injuries included cerebral palsy, microcephaly, vision problems, seizures, paralysis and more. Although, some of the baby’s medical issues may not have been a result of the physician’s delayed treatment, the parents believed an earlier delivery may have prevented or may have lessened the severity of the baby’s injuries. The hospital agreed to settle and cover the child’s expected medical expenses, but also ensured that the federal government was responsible for half of the settlement since the physician worked for a federally funded clinic.
The result of brain injuries for any reason can result in a lifetime of medical treatment, expenses, assistance with care, inability to earn income and other potential handicaps.
