Medical and surgical errors can be debilitating to patients

On Behalf of | Apr 18, 2017 | Surgical Errors

Medical practice standards and pharmaceutical recommendations can change quickly due to new data and research available. Medical professionals in Delaware are responsible for understanding the medicines they administer and the changes in their recommendations. When medical professionals fail to follow current safety guidelines, medical and surgical errors may occur. One 57-year-old woman in another state discovered how her practitioner’s ignorance of safety guidelines was detrimental to her health and way of life.

The woman received a steroid injection into her spinal column at a surgery center in 2013. As a result, she suffered a spinal infarction or stroke, which paralyzed her. She now requires personal and medical assistance 24 hours a day.

Evidence was later discovered that the woman should have never received the steroid injection in her spinal column. Documentation indicates that the manufacture of the drug she received, had approval as early as 2011 to begin labeling the medicine with a warning not to use it as an epidural. The couple filed a medical malpractice lawsuit in a civil court in their state. After reviewing the evidence presented, a jury awarded the couple $14.9 million.

Unfortunately, life will never be the same for the couple, and the woman may never walk again. The settlement they received will surely aide in her care and therapy for the rest of her life. Patients that feel they have suffered unnecessary medical or surgical errors may find it beneficial to speak with an experienced medical malpractice attorney in Delaware regarding their litigation rights in civil court.
