Lawsuit claims surgical errors lead to fatality

The estate administrator of a woman who died in 2007 is suing two doctors and their associated hospital for her death. The man, whose mother passed away in December 2007, filed a malpractice suit on July 11 in another state against both attending doctors who oversaw a surgery his mother underwent. In Delaware and elsewhere, surgical errors leading to death are appropriate grounds for a medical malpractice claim. 

Apparently, the woman underwent a surgery to repair a hernia in December 2007 at the hospital in question. It is alleged that her bowel was perforated during the procedure, leading to her death a short time later. The plaintiff claims that the doctors on the scene did not evaluate the woman’s post-op complications and provide adequate treatment for the surgical error. 

The plaintiff has requested a trial by jury and is seeking damages in excess of $50,000, not including associated court costs. The case is currently being overseen by the Cook County Circuit Court in Chicago. It remains to be seen how the malpractice litigation will be resolved. 

Surgical errors are a terrifying prospect for any Delaware resident who has to undergo surgery, as they can lead to complications, further illness or even death. However, if the worst does happen, legal machinery is in place to help the individual and/or a deceased victim’s family to seek compensation when doctors commit such errors. Appropriate proof that the negligence alleged deviated from the acceptable medical standard will be required.
