A tragic case of medical malpractice has recently been settled, according to local legal sources. Delaware residents will be pleased to hear a case involving a woman who died of brain injuries in May 2013 has finally found justice after her family was awarded an undisclosed settlement. The case was resolved only a week into the trial.
According to the court documents that have been made public, the woman in question was a recently graduated doctor who had taken up a pediatric residency shortly before she died. Unfortunately, she succumbed to brain hemorrhaging on May 29, 2013, at age 26. Her legal representative argued that she was misdiagnosed and mishandled by the hospital and staff she went to for help.
Three days’ worth of testimony described as “damaging” against the hospital and the attending doctors resulted in an out-of-court settlement. The thrust of the plaintiff’s case was that the young woman was considered a rising star who could have earned millions if she had been able to complete her career. Had a jury agreed to this, the hospital could have been facing damages in the tens of millions.
Thankfully, a trial was avoided for the family of the deceased doctor, and the hospital settled out-of-court. However, for some individuals in Delaware suffering from brain injuries brought on by malpractice, the cases may not be so easily decided. Medical law is challenging and complicated, and it requires extensive knowledge to effectively navigate.
