Hot on the heels of settling a lawsuit involving the untimely death of a promising doctor, an embattled health provider is preparing to face another suit for another allegedly mistreated blood clot. Delaware residents may be aware of the death of a 26-year-old mother of two who passed away as a result of brain injuries due to a hemorrhage on April 1, 2013. This new trial is scheduled to begin on April 4 of this year.
Representation for the woman’s family have stated that doctors were too slow in recognizing the symptoms of a blood clot in the woman’s brain. Further, they did not administer treatment in a timely manner when her condition got worse. This is a mistake attorneys say contributed to the brain injuries that caused her death.
According to the filed complaint, the woman went to the health center’s emergency department on March 22, 2013 with symptoms that included intense headaches. The hospital did not conduct a neurological exam and discharged her just over an hour later. She went to a different emergency room several days later and was rushed to the medical center for a three-day stay.
When she was released, she was still complaining of weakness, blurry vision, dizziness, ringing in the ears, numbness and tremors. Doctors at the hospital advised her to continue outpatient treatment, but did not offer consultation services. On April 1, she was rushed back to the center, where she later died of irreversible brain damage.
Given this is the second such instance of brain injuries resulting from misdiagnosis at the same hospital, this woman’s estate may be able to reach a settlement of the claims. However, this will not bring the victim back to life. Thankfully, damages awarded in a malpractice suit of this nature, whether in Delaware or another state, typically provide restitution for a broad range of financial losses.
