Physician group to terminate care due to birth injuries lawsuit

Delaware parents may be interested to learn about a couple in another state who had a baby boy in 2011. Complications during the birth allegedly led to the boy’s birth injuries. Now the family may no longer be able to take their brain-damaged son to any of the more than 600 doctors who work for the physicians’ group, which they are suing.

A 3-year-old boy has brain damage. He was born in Nov. 2011. In Oct. 2014, his parents filed a medical malpractice lawsuit against the physicians’ group because of the care that the mother received during labor and the delivery of the son. The suit alleges that, due to lack of oxygen during the birth, the boy has suffered permanent brain damage.

Now the brain-damaged child and his family are faced with a new challenge: the physicians’ group plans to discontinue care for the boy and his family. The family feels that this action is retaliation for the pending lawsuit. An attorney for the physicians’ group says that this is common practice for physician groups that are being sued, as it is a safeguard against ethical conflicts. The parents are seeking an emergency injunction so they have time to find new health care providers for their son.
