Many Delaware residents choose walking as a main source of transportation these days. Traveling by foot is economical and also a great way to stay in shape and maintain a healthy lifestyle. However, walking near busy roadways is dangerous. In many states throughout the country, car accidents involving pedestrians are at an all time high. Tragically, these types of accidents have a higher risk of serious injury or death.
A recent accident near Ardentown claimed the life of a pedestrian. The accident happened on Interstate 95 in the southbound lanes during the overnight hours. According to reports, a female pedestrian was attempting to cross the roadway when she was suddenly struck by a southbound SUV.
Reports said the SUV hit the pedestrian with the front bumper and continued on the roadway before colliding with a guardrail on the edge of the highway and coming to a stop. Tragically, the pedestrian was pronounced dead at the scene of the accident, authorities said. Reportedly, the driver of the SUV was not injured in the accident and police do not suspect impairment was a factor.
Although laws exists for the safety of pedestrians and drivers alike, car accidents involving pedestrians will likely increase as populations rise. Anytime someone suffers injuries or the loss of a loved one due to an act of negligence in an accident, he or she has a right to pursue legal action. It remains to be seen if that will be the case due to this tragedy; as Delaware is a comparative negligence state, an accident victim (or the victim’s estate when a death results) must show the defendant was more than 50% responsible for the accident. A successfully litigated claim could result in much-needed compensation that victims and families could use to cover medical bills and other expenses.
