Family awarded over $50 million for birth injuries

Birth is a very fragile and delicate time in which great care is required. Any missed step or deviation from the accepted standard of care can result in birth injuries that will affect the child for the rest of his or her life. A family in another state recently received a substantial amount in damages from a lawsuit they filed after their son was injured during birth. The boy now suffers from cerebral palsy that the family claims is a result of negligent care. According to the lawsuit, providers failed to adequately monitor the mother's contractions and gave her the drug Pitocin, which causes stronger contractions. Plaintiffs claimed that the infant was struggling in the womb and the stronger contractions caused by the medication placed great amounts of stress on the baby.

Reportedly, the baby was born unable to breathe on his own. The plaintiffs claimed that, although providers were able to resuscitate the boy, the lack of oxygen resulted in severe brain injuries and caused their son to develop cerebral palsy. The family says the boy is now severely disabled and struggles with everyday, basic tasks. The plaintiffs were awarded over $50 million.

The main concern of soon-to-be parents is a safe and healthy birth for both mother and child. Any error during this process, no matter how minor, can result in birth injuries that affect families for a lifetime. Delaware families who have suffered as a result of negligence during childbirth could benefit by seeking the services of a knowledgeable attorney. A successfully litigated lawsuit could provide families with deserved compensation as well as a sense of justice.
