Delaware’s Injury And Medical Malpractice Leaders

What to do if you're hurt when in an Uber

With many prominent beaches, Uber drivers in Delaware are able to make a good living, and for riders, it is a convenient way to get around the state.

However, Uber drivers are prone to accidents like any other motorist. When you are the passenger in an Uber or Lyft, you want to make sure you take care of your own well-being. The steps you take after a ridesharing accident will be roughly the same as any other.

Make sure everyone is safe

Check on yourself and anyone else in the vehicle to see if there are any significant injuries. You will then want to check in on the people in the other car involved if there is one. Regardless of how you feel, you should schedule an appointment with your doctor within 72 hours of the incident. This helps with insurance purposes.

Call police and paramedics if needed

If someone has sustained a serious injury, then an ambulance needs to come to the scene. Regardless of injuries, someone should contact the police so that an officer can create an official report. This report is crucial if you need to go to court to try to collect damages. If your driver tells you not to get the police involved, you should still do so. This is for your own benefit.

Contact the ridesharing app

You will want to report the accident to Uber or Lyft afterward. The company will email you some forms you will need to fill out for its benefit. Determining who is liable in terms of insurance is tricky in these situations because drivers are not officially employees of the company. They are independent contractors, but every driver should have commercial insurance to cover these incidents. Filing a lawsuit directly against the company is tough, but the employer may hold some liability if it did not properly screen the driver.
