Delaware’s Injury And Medical Malpractice Leaders

In another state, the family of a deceased woman has learned the complexity of the judicial system as their case is being processed in the courts. The patient's estate chose to seek compensation from her two surgeons, the university the surgeons worked for and the hospital where the surgery took place. The hospital maintains a relationship with the university that employed the physicians in order for medical students to gain hands-on experience. In a hearing, a circuit court judge ruled that the teaching hospital did not have responsibility in the woman's death and should not be a defendant. After an appeals court agreed with the circuit judge, they woman's estate took the case to the state's Supreme Court to challenge the previous decisions.

Although the state's Supreme Court ruled that the teaching hospital was not responsible for the surgical errors that may have led to the woman's death, the other parties may still be held responsible. The aftermath of handling medical and unexpected funeral expenses can be expensive for families.
