Woman blames brain injuries on failure to diagnose

Many Delaware residents suffer from severe headaches and migraines without any underlying brain issues. However, sometimes, those headaches are an indication of a larger problem. If a doctor fails to take the appropriate steps to ensure that a proper diagnosis is made, permanent brain injuries can occur. This is what one out-of-state woman said happened to her.

The woman went to see a doctor complaining of a severe headache. She claimed that it was the worst one she had ever had in her life, but the doctor failed to order any tests to ensure that it was not more than just a headache. In the lawsuit she filed against the doctor, she alleged that the doctor failed to perform neurological or physical examinations to determine its cause.

Sometime later, the Connecticut woman discovered that she suffered an intracranial aneurysm that had ruptured. She went on to claim that due to the failure to diagnose the neurovascular event, she now requires assistance in performing day-to-day activities. Prior to the case going to trial, she and the doctor settled the woman's claims for $2 million.

A large portion of medical malpractice claims settle before making it to trial. Whether a Delaware resident is claiming permanent brain injuries or some other permanent injury due to a failure to diagnose or another medical mistake, settlement will more than likely be an option at some point. Litigation can be a daunting prospect, and that is often a primary factor in considering a settlement. However, depending on the circumstances, an offer of settlement might be for far less than the victim -- or the victim's family in case of death -- deserves. It would be advisable not to accept any settlement without first having it reviewed by an attorney.
