Patient files malpractice charges for 14-year-old surgical errors

A woman is charging a doctor for an error allegedly made some fourteen years ago, according to sources local to the filing. Delaware residents will doubtlessly be shocked to hear that the woman is alleging a 15-centimeter long surgical clamp was left in her abdomen following a surgery meant to address ovarian cysts. The surgical errors were apparently made in August 2000.

According to the filing, the error was discovered in June 2014, and the clamp was subsequently removed. The woman claims that as a result of this error, she has experienced over a decade of pain and fatigue, particularly as it pertains to her menstrual cycle. She has also mentioned a reduced ability to enjoy activities.

The plaintiffs, which include the patient as well as her common-law husband, are requesting that the defendants pay for damages, attorney fees and associated court costs. They have also requested a jury trial to address the issue. Their filing will influence both the attending doctor and the assistant on-site at the time the surgery was performed. At the moment, representation for the defendants have vehemently denied the charges, calling them malicious and unfounded.

Delaware residents would be likely shocked to hear that surgical errors of this type and severity could have taken place. Thankfully, medical malpractice lawsuits with sufficient evidence to prove the culpability of the medical professional involved can often result in damages being paid out to the plaintiffs. Of course, malpractice law can be quite complicated, so it can be of considerable benefit to the plaintiffs to seek out qualified attorneys to aid them in any malpractice suit they choose to file.
