Delaware’s Injury And Medical Malpractice Leaders

Malpractice case settled after child suffers brain injuries

A family whose child contracted cerebral palsy after a botched experimental surgery has been granted justice, according to local sources. Delaware residents will be pleased to hear the family of a 6-year-old boy from another state who suffered brain injuries directly after his birth have been awarded $30 million by the court. This settlement is enough to ensure the boy's care for the rest of his life, care he will richly require.

The court documents state that back in 2011 when the child was born, a leak was found in his esophagus, prompting the attending physician to perform an operation. Over the following year, this doctor performed 24 more surgeries, all of which were considered "novel" by some. On the occasion of the final surgery, the court found that he improperly used a surgical needle, resulting in a rupture in the child's pulmonary artery.

The repercussions of this action were far-reaching. The child suffered brain injuries and now lives with cerebral palsy, a degenerative condition that will leave his family responsible for his care for most of his life. The court ruled in favor of the family and awarded them $30 million in reparations.

Every medical malpractice case is different. Sometimes, brain injuries are difficult to correlate with doctor error. However, if a Delaware resident believes he or she has been the victim of malpractice, seeking the support of a qualified attorney is a good place to start. They can provide the legal knowledge necessary to navigate a malpractice case and hopefully secure reparations for the victim.
