Delaware’s Injury And Medical Malpractice Leaders

Surgical errors among leading causes of personal injury suits

Most non-elective surgeries are processes the average American would rather avoid. As some Delaware residents can attest, the stress of needing surgery is compounded by the fear of surgical errors exacerbating an existing condition or causing a new one. While not as common as Hollywood might have people believe, surgical errors do happen, and they happen with enough frequency that they are fast becoming the most likely reason for a medical malpractice claim.

A recent study published by the Journal of American Medicine suggests that a serious surgical error occurs roughly once in every 10,000 surgeries. Considering some 51 million surgeries were conducted in 2014 alone across America, this accounts for roughly 5,000 botched surgeries that year. While this does not appear to be a particularly substantial number given the population, one estimate suggests all medical errors combined accounted for around 400,000 deaths in the same year.

Surgical errors can take many forms, from wrong-site surgeries to burns inflicted in surgical fires to surgical implements being left in the patient. Depending on the severity of the error, some can be immediately fatal, while others can cause long-term and expensive health issues. While a great deal of work has been done to reduce the events of surgical errors yearly, thousands of people are still affected every year.

Thankfully, Delaware residents who have been the unfortunate victims of surgical errors have legal recourse available to them. Medical malpractice suits offer a way to receive financial compensation for the pain and suffering that can so often come from these events. With dedicated representation in place, those who have suffered as a result of someone else's mistake can enjoy a degree of justice.
