Man sues for malpractice after suffering brain injuries

A Supreme Court jury has awarded a man $11.6 million in a landmark malpractice case, according to local sources. The man suffered brain injuries after being incorrectly diagnosed by a local radiologist, according to the case. Delaware residents will likely be pleased to hear that the jury found in the man's favor. 

According to court documents, the man was suffering from an undiagnosed stroke on Jan. 25, 2012 when he went to the hospital complaining of headaches, dizziness and trouble with his balance. He was submitted for a CT scan, which revealed the presence of a blockage in a blood vessel in his brain. However, the attending physician diagnosed him with a sinus infection and sent him home. 

Seven weeks later, the man suffered a massive stroke that his lawyers say has left him permanently disabled. As a result of this stroke, he also lost his business. After 3 1/2 hours of deliberation, the jury ruled in favor of the man, and the court awarded the largest malpractice settlement in the history of the area. 

Brain injuries can cause permanent disabilities in individuals who suffer them. In cases where these injuries could have been prevented if the attending doctor was more careful, legal precedent here in Delaware and throughout the nation says the victim is entitled to sue for malpractice. With the support of a professional legal team, it is possible to challenge the competence of a medical doctor in such a situation, and in some cases, this challenge can lead to damages being rewarded.
